PROPOSED AMENDMENTS TO myPPP CONSTITUTION

Article 39  REGIONS

 

39.1            MyPPP in addition to Peninsular Malaysia, shall set up 2 more Regions comprising Sarawak and Sabah.

 

39.2            The Regions of Sarawak and Sabah shall be represented by a Regional Council comprising a Regional Chairman, Deputy Chairman, 5 Vice Chairman, Secretary, Treasurer and Information Chief, deputy Secretary, deputy Treasurer, deputy Information Chief and 28 Ordinary Council members to be elected by the delegates in each Region and 9 Ordinary Council members to be appointed by the Chairman.

 

39.3            Decisions of the Regional Council shall be by majority of votes and the Chairman shall have a casting vote.

 

39.4            No decisions in respect to the Regions of Sarawak and Sabah shall be made by the General Assembly and/or the Supreme Council without the prior written approval of the said 2 Regions.  Any future proposed amendments to this Constitution, in respect of the 2 said Regions, shall be in consultation with the 2 said Regions.

 

39.5            Each Region will nominate in writing one Vice President each to sit in the Supreme Council and 10 Ordinary Supreme Council members in the Supreme Council from the Regions of Sarawak and Sabah.

 

39.6            Not with standing anything to the contrary stated in this Constitution, the following provisions shall apply to the Branches, Divisions, State Committee and Regions set up in Peninsular Malaysia, Sarawak and Sabah. To the extent if there is any inconsistency with any other provision in this Constitution, the provisions of Article 39 shall prevail.

 

8.3              Delegates at the General Assembly will be elected at the

                  Divisions. One half (1/2) of the Delegate’s roll or

1000 delegates shall be sufficient quorum for any General Assembly.

8.3              Delegates at the General Assembly will be elected at the

Respective Branches. The list of the elected delegates will be subject to the final approval by the Supreme Council. One half (1/2) of the Delegate’s roll or 1000 delegates shall be sufficient quorum for any General.

8.4.6           Elections of the Supreme Council shall only be held during an Annual General Assembly approved by the Supreme Council and called by Notice by the Secretary General and no elections of the Supreme Council members shall be held in any Extraordinary General Assembly.

8.4.6           Elections of the Supreme Council shall only be held during an Annual General Assembly except as provided for under Article 9.12, wherein prior approval must be obtained by the Supreme Council. Notice of such elections will be issued by the Secretary General. No elections of the Supreme Council members shall be held in any Extraordinary General Assembly.

9.2              The Party’s principle officers are:

 

         9.2.1  President

                  9.2.2    Five (5) Vice Presidents

                  9.2.3    Secretary General

                  9.2.4    Treasurer General

                  9.2.5    Information Chief

                  9.2.6    The Chief of the Woman’s Movement

                  9.2.7    The Chief of the Youth’s Movement

                  9.2.8    The Chief of the Puteri’s Movement

                  9.2.9    The Chief of the Putera’s Movement

9.2.10 Not more than eighteen (18) Ordinary Council       

 members elected by the General Assembly

 

9.2.11 Not more than six (6) Ordinary Council members   

 appointed by the President

  and Two (2) Vice Presidents one each from the   

  Regions of Sarawak and Sabah.

                  9.2.4    Treasurer General

                  9.2.5    Information Chief

                  9.2.6    The Chief of the Woman’s Movement

                  9.2.7    The Chief of the Youth’s Movement

                  9.2.8    The Chief of the Puteri’s Movement

                  9.2.9    The Chief of the Putera’s Movement

9.2.10  Not more than eighteen (18) Ordinary Council       

  members elected by the General Assembly

 

9.2.11 Not more than six (6) Ordinary Council members  

  appointed by the President

 

9.2.12 Not more than 10 Ordinary Supreme Council    

           members of which Five (5) from each Region of  

           Sarawak and Sabah.

                          

9.6              A candidate for the post of President must have been a Party member for more than    nine (9) years. A candidate for the post of Vice President must have been a Party member for more than five (5) years. A candidate for the post of Supreme Council must have been a Party member for more than three (3) years. Appointments by the President pursuant to Article 9.9.1.2 and 9.9.1.5 are not restricted by this clause.

9.6              A candidate for the post of President must have been a Party member for more than    three (3) years. A candidate for the post of Vice President must have been a Party member for more than two (2) years. A candidate for the post of Supreme Council must have been a Party member for more than one (1) year. Appointments by the President pursuant to Article 9.9.1.2 and 9.9.1.5 are not restricted by this clause.

 

9.8              The Party’s Principal Officers are :

9.8              The Party’s Principal Officers are :

 

9.8.2           Five (5) Vice Presidents from the Peninsular Region and Two (2) Vice Presidents one each from the Regions of Sarawak and Sabah.

11.1            One (1) State Committee shall be appointed by the President upon the consultation with the Supreme Council in each state and Federal Territory. The Supreme Council has the power to suspend or dissolve such State Committee, and appoint a new State Committee.

PROPOSED AMMENDMEND

 

11.1            Article 11 shall only apply to the States of Peninsular Malaysia and the Federal Territories whereas Article 39.2 is applicable to Sarawak and Sabah. In Peninsular Malaysia, One (1) State Committee shall be appointed by the President upon the consultation with the Supreme Council in each state and Federal Territory. The Supreme Council has the power to suspend or dissolve such State Committee, and appoint a new State Committee.

 

11.3            The Chairman of the State Committee, two (2) Vice Chairman and twelve (12) Ordinary Committees members shall be elected at the Annual State Convention by Delegates who have been selected to attend from amongst those elected at Branch meetings pursuant Article 16.3.6 and 16.3.7 and they shall hold office for a period of three (3) years from the date of their election but can be dismissed at anytime by the President in consultation with the Supreme Council.

11.3            The Chairman of the State Committee, two (2) Vice Chairman and twelve (12) Ordinary Committees members shall be elected at the Annual State Convention by Delegates who have been selected to attend from amongst those elected at Branch meetings pursuant Article 16.2.6 and 16.2.7 and they shall hold office for a period of three (3) years from the date of their election but can be dismissed at anytime by the President in consultation with the Supreme Council. 

11.9            The State Committee shall convene a convention at State and Federal Territory level at least once a year of Delegates who have been selected to attend from amongst those elected at Branch meeting pursuant to Article 16.3.6 and 16.3.7. The Supreme Council has the power to determine the conduct and other matters regarding the convention.

11.9            The State Committee shall convene a convention at State and Federal Territory level at least once a year of Delegates who have been selected to attend from amongst those elected at Branch meeting pursuant to Article 16.2.6 and 16.2.7. 16.2.5         Elect once every two (2) years , two (2) Ordinary Committee Member.

16.2.5         Elect once every three (3) years, three (3) Ordinary Committee Members

17.1.7         Two (2) Ordinary Committee Members

  

PROPOSED AMMENDMEND

 

17.1.7         Twenty (20) Ordinary Committee Members of whom (8) shall be appointed by the Chairman.

  

6.10            When a member of the Party is either elected or appointed to serve as a representative of the Party on any legislative or other Governmental, Public Body, Statutory Body, Governmental Linked Corporation, State Agencies or Municipal Councils,  such member shall enter into a legally enforceable agreement with the Party prior to taking such position. This agreement will be executed by the Public Officer of the Party and witnessed by the Secretary General. The agreement will state, inter alia, that should he either be removed as a member or resigns as a member of the Party or joins another Party, such member shall immediately cease to hold any position in the Party, even if the position was through an election. He shall immediately upon such removal or resignation shall tender his resignation. A notice will be sent by the Party requesting him to do so if he has not already done so. The member shall forthwith return his membership card to the Supreme Council and if that individual refuse to return the card as aforesaid, the Supreme Council may at its sole and absolute discretion publish in any media of the Supreme Council’s choosing the details of the expulsion or cessation of such membership (as the case may be) in any way considered fit and such publication shall be proof of the member’s expulsion from the Party or cessation of membership of the Party. Should such member refuse to relinquish any position or the Public Office after 14 days from the date of the notice, such member shall become liable to pay the Party agreed damages calculated at RM1000.00 per day from the 15th day of the notice from the Party until the date he has formally relinquished or been discharged or removed from the Public Office or completes his term.

The Supreme Council and if that individual refuse to return the card as aforesaid, the Supreme Council may at its sole and absolute discretion publish in any media of the Supreme Council’s choosing the details of the expulsion or cessation of such membership (as the case may be) in any way The member shall forthwith return his membership card to the Supreme Council and if that individual refuse to return the card as aforesaid, the Supreme Council may at its sole and absolute discretion publish in any media of the Supreme Council’s choosing the details of the expulsion or cessation of such membership (as the case may be) in any way considered fit and such publication shall be proof of the member’s expulsion from the Party or cessation of membership of the Party.
